The Digital Chamber Asks SCOTUS to Protect Young Crypto Industry

The Digital Chamber told the US Supreme Court that it should reverse a federal circuit court opinion allowing a securities fraud case against Nvidia Corp. to proceed because the ruling was based on speculative evidence.

"[E]merging startup and high-technology businesses are highly susceptible to unqualified expert speculation and are most likely to be harmed if an expert opinion can be substituted for particularized factual allegations,” the amicus brief filed Tuesday said. Application of the strict pleading standards under the Private Securities Litigation Reform Act “should protect the entire cryptocurrency industry,” it said.
